1. Terms and definitions

The seller , the online store brabrabra — sole proprietor Voloshchuk Inga Andreevna, sole proprietor Gudym Natalia Nikolaevna, sole proprietor Lebed Sergey Aleksandrovich and sole proprietor Onishchenko Viktor Nikolaevich — entrepreneurs created in accordance with the legislation of Ukraine, selling goods remotely, including using the information and telecommunications network "Internet" through the online store at the address: brabrabra.ua .

User – an individual using the services of the Site, individual functions of the Site.

The buyer is a citizen who intends to purchase goods exclusively for personal, family, household and other needs not related to entrepreneurial activity.

Remote Sale of Goods means the sale of Goods under a retail sale and purchase agreement concluded upon the Buyer's review of the Seller's description of the Goods, as well as the terms of payment, delivery, and warranties contained on the Online Store website. According to Part 6 of Article 11 "On Electronic Commerce," a retail sale and purchase agreement is considered concluded upon the Buyer's completion of the order process—the Buyer's acceptance of this Public Offer and the Buyer's agreement to the terms of this Public Offer.

Confirmation of the conclusion of a retail sale and purchase agreement is the issuance by the Seller to the Buyer of a cash or sales receipt or other document confirming payment for the Goods.

The online store is a resource owned by the Seller, located on the Internet at the address: brabrabra.ua , where the Products offered by the Seller for purchase are presented, as well as the information necessary when making a purchase, including: price, methods and conditions of payment and delivery, addresses for pickup of the Products.

The website of the online store , owned by the online store and administered by it, is a set of logically interconnected web pages containing information about the Products and the terms of their purchase, at the address: brabrabra.ua

Personal Account — the User's personal space, a personalized interface of the Site with a set of user tools for using the Site's personalized services.

An order is an electronic or oral request/application from the Buyer to purchase Goods from the assortment of the Online Store under the terms of this Public Offer.

Product – products, information about which is posted on the Website.

Services — a set of activities undertaken by the Online Store in relation to the Buyer, carried out for the purpose of fulfilling the terms of the retail sale and purchase agreement for the Goods, including, but not limited to, such services as delivery of the Order to the Buyer, informing the Buyer about the progress of the agreement, etc.

2. General Provisions

1. The information posted in the Online Store on the Website at: brabrabra.ua contains the terms of the offer to purchase the Goods and constitutes a Public Offer, in accordance with Part 2 of Article 11 of the Law of Ukraine "On Electronic Commerce" and Articles 641 - 643 of the Civil Code of Ukraine.
2. In accordance with Part 2 of Article 11 of the Law of Ukraine "On Electronic Commerce" and Articles 641-643 of the Civil Code of Ukraine, this Public Offer is an official offer of the Seller, addressed to an indefinite number of persons, to conclude a retail sale and purchase agreement for the Goods with the Buyer who has placed an Order.
3. An order is considered completed and transferred to the Seller upon completion of the Order placement process in the Online Store. The Buyer's completion of the Order placement process constitutes the Buyer's acceptance of the Public Offer and agreement with the terms of this Public Offer.
4. This Public Offer may be amended by the Seller without any special notice to the Buyer/User. The new version of the Public Offer shall take effect upon its posting on the Website and shall not apply to legal relations between the Buyer and the Online Store that arose prior to the entry into force of the new version of the Public Offer, unless otherwise provided in the new version of the Public Offer.
5. In its activities, the Online Store is guided by the provisions of the Civil Code of Ukraine, the Law of Ukraine "On the Protection of Consumer Rights", the Law of Ukraine "On Electronic Commerce", "Rules for the Sale of Goods to Order and Outside of Retail and Office Premises", other regulatory acts and laws of Ukraine.
6. The Buyer and Seller represent and warrant that they possess the necessary legal capacity, as well as all rights and powers necessary and sufficient to enter into and execute this offer and the retail sale and purchase agreement for the Goods. Each party is responsible for any inaccuracies in the information provided.
7. The online store is not responsible for the accuracy and correctness of the information provided by the User/Buyer when registering on the Website or placing an Order. To place an Order, the Buyer must provide valid information necessary to fulfill the Order. The Buyer is responsible for the validity and/or relevance of the information, as well as for any incorrect information provided by the Buyer and/or the Buyer's representative.

3. Product and purchase procedure

1. All text information and graphic images posted on the website are the property of the online store.
2. The products presented in the online store, where required by Ukrainian law, have all necessary certificates and fully comply with the norms and requirements of Ukrainian law. If the Buyer has any questions regarding the properties and specifications of the Product, they should contact the online store for advice before placing an Order.
3. The photographs accompanying the Product are for illustration purposes only and may differ from the actual Product. The quality, settings, and characteristics of the User's computer screen may distort the color range of the Product shown. The Product may differ slightly from the image shown on the Website in color, shape, size, or other parameters. Any specifications of the Product are subject to change by the manufacturer without prior notice.
4. The Buyer has the right to contact the Online Store's customer support for additional information regarding the Product of interest. At the Buyer's request, the Seller is obligated to provide (by phone or email) any other information deemed necessary and sufficient by the Buyer to enable them to make a purchasing decision.
5. The availability of Products presented in the Online Store catalogue is determined by the individual Product status displayed on the Product page in the Online Store.
6. The price of the Product is indicated in the national currency of Ukraine – the hryvnia. The Buyer is hereby informed that the sale of the Product in the Online Store is conducted in real time (24 hours a day) and is subject to price and availability changes without prior notice. Therefore, the Product is reserved for the Buyer only after the Order is processed by the Online Store.
7. The final price of the Product may be reduced at the Buyer's initiative by applying discounts, subject to compliance with the terms of the Seller's promotional campaigns - bonuses, discounts in accordance with the Seller's terms.
8. To clarify information about the Product, the Buyer can contact the Customer Support Service by phone: 0445800088 from 08:00 to 22:00 Kyiv time.
9. Both registered and unregistered Users can place Orders through the Online Store.
10. The User has the right to register on the Site only 1 (one) time, that is, he/she can have only one Personal Account linked to one email address.
11. When registering on the Website, the User receives individual identification by providing their login and password for their Personal Account. Individual identification of the User prevents unauthorized third-party actions on the User's behalf and provides access to additional Website services.
12. To register, the User undertakes to provide information about themselves as prompted by the registration form and to keep this information up to date. If the User provides incorrect information or the Seller has reason to believe that the information provided by the User is incomplete or inaccurate, the Seller reserves the right, at its sole discretion, to block or delete the User's account and deny the User access to its services (or individual features thereof).
13. Personal information or information contained in the User's account is stored and processed by the Seller in accordance with the terms of the agreement.
14. The Buyer may place an order for the Goods in the following ways:
    • by independently placing the Goods in the “basket” and filling out the Order form;
    • by calling Customer Support on 0445800088 , indicating the Product and the main conditions for its purchase.
15. If technically possible, the Seller provides the Buyer with the opportunity to receive SMS messages from the Seller regarding the Order status when placing an Order.
16. After placing the Order, the Buyer is provided with information about the estimated date of delivery of the Goods to the Buyer or the date of delivery of the Goods to the Buyer's selected pick-up point/retail store of the Seller, if the Buyer selected pick-up when placing the Order, by sending an SMS message to the Buyer's phone number specified when placing the Order, or by phone, at the discretion of the Seller.
17. If the Products ordered by the Buyer are unavailable in the Seller's warehouse, the Seller has the right to exclude the specified Product from the Buyer's Order by notifying the Buyer via the Buyer's preferred method of communication. In this case, the Buyer has the right to cancel the Order in whole or in part. If the Buyer has prepaid for the Order, and the Buyer cancels the Order in whole or in part, the price of the Product will be refunded to the Buyer using the method used to pay for it.

4. Delivery or receipt of Goods

1. The seller offers delivery services. The delivery method, mode of transport, delivery times, and delivery costs are listed on the website in the "Delivery and Payment" section .
2. Delivery costs are calculated individually (based on dimensions, region, purchase amount, etc.). The final order cost is communicated to the Buyer via SMS and/or generated on the website in the personal account and/or when placing an order without registration.
3. The delivery territory for the Products presented on the Website and sold by the Seller is limited to the territory of Ukraine, with the exception of temporarily occupied territories, including the Autonomous Republic of Crimea.
4. The online store has the right to deliver the Goods using the services of third parties, while remaining responsible for the proper fulfillment of its obligations.
5. Upon delivery, the Order is handed over to the Buyer or a third party specified in the Order as the Recipient (hereinafter in this section, the Buyer and the third party are referred to as the “Recipient”).
6. If the Recipient is unable to receive the Order, and the payment method chosen is cash upon receipt of the Goods, the Order may be handed over to a person who can provide information about the Order number and pay the full cost of the Order.
7. When delivering a prepaid order, the courier reserves the right to request identification documents from the recipient to prevent fraud. The online store guarantees the confidentiality and protection of the recipient's personal data.
8. Upon acceptance of the Goods, the Recipient is obligated to inspect the Goods and verify their compliance with the stated quantity, assortment, and completeness, as well as check the Goods' shelf life and the integrity of the packaging. The risk of accidental loss or damage to the Goods passes to the Buyer upon delivery of the Goods and the Recipient's signature on the documents confirming receipt of the Goods.
9. When the Goods are delivered by courier, the time spent by couriers delivering the Goods to the Recipient, as well as all mutual settlements with the courier, is limited to 15 minutes of waiting for the Recipient after the courier notifies the Recipient of their arrival at the delivery location of the Goods.
10. If the Order is delivered by one of the specified postal services (including courier delivery) in Ukraine, the postal service chosen by the Buyer is responsible for its safekeeping and transit time within Ukraine from the moment the shipment is handed over to the postal service. Complaints regarding the tracing of postal items will be processed in accordance with the operating rules of the respective postal service and current Ukrainian legislation.

5. Payment for the Goods

1. Payment for the Goods is made upon receipt of the Goods in cash or using bank cards.
2. Features of payment for goods using bank cards:
   • According to the procedure for conducting operations with bank cards, such operations are carried out by the cardholder or a person authorized by him.
   • Banks authorize bank card transactions. If a bank has reason to believe a transaction is fraudulent, it has the right to refuse to process it. Fraudulent transactions with bank cards are covered by the Criminal Code of Ukraine.
   • When making an advance payment for the Goods, the Seller sends the Buyer an electronic receipt to the Buyer's email address specified when placing the Order.

6. Refusal of the Goods, return of the Goods and money

1. The Buyer has the right to refuse the Goods at any time before their delivery, and after the delivery of the Goods, in accordance with the procedures and within the timeframes specified in the “Exchange and Return” section of the Website.
2. Return of Goods of proper quality is possible in the cases and according to the procedure specified in the “Exchange and Return” section of the Website.
3. Upon receipt of the Order at the post office and/or by courier (including the postal service), the Buyer must ensure that the outer packaging is intact and free from mechanical damage. If any of the above defects are discovered, the Buyer must, together with the postal employee, draw up a damage report, open and inspect the Product, and record all defects in the report. After inspection, the Buyer has the right to either purchase or refuse the parcel.
4. When choosing mail delivery, the Buyer can cancel the Order (refuse the Product) up until the moment it is delivered from the online store to the post office. After this, Order cancellation is not possible.
5. If the Buyer refuses to receive the Goods at the post office and/or from the courier, the Seller shall return to him the amount paid by the Buyer in accordance with the retail sale and purchase agreement, excluding the Seller's costs for delivery (return) of the undelivered Goods, no later than 10 days from the date of refusal to receive the goods.
6. The refund of the amount paid by the Buyer for the Goods is carried out in the same way in which the payment for the goods and their supply was made.

7. Confidentiality and information protection

1. The personal data of the User/Buyer is processed in accordance with the Law of Ukraine "On the Protection of Personal Data".
2. When registering on the Website, the User provides the following information: name, contact mobile phone number, email address, and delivery/pickup address for listed Products. The User may provide additional or suggested information at their own discretion.
3. The Buyer voluntarily and knowingly provides the data when placing an Order in the Online Store as necessary for the Seller to fulfill the Buyer's Order. The Seller, which processes the Buyer's personal data as necessary, has taken sufficient organizational and technical measures to protect this personal data from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, or other illegal actions.
4. By providing their personal data to the Seller, the User/Buyer agrees to their processing by the Seller, including for the purpose of fulfilling the Seller's obligations to the User/Buyer under this Public Offer.
5. The seller has the right to use cookies. Cookies do not contain confidential information and are not transferred to third parties.
6. The Seller receives the Website User's IP address. This information is not used to identify the visitor and is not shared with third parties.
7. Buyers and Users agree that the Seller has the right to record telephone conversations with the Buyer without their prior consent. The Seller undertakes to prevent unauthorized access to information and/or its transfer to persons not directly involved in the fulfillment of Orders, and to promptly identify and stop such incidents.

8. Duration of the Public Offer

1. This Public Offer shall enter into force from the moment of its acceptance by the Buyer and shall remain in effect until the Buyer and Seller fulfill their obligations under the retail sale and purchase agreement for the Goods.

9. Additional terms

1. The Seller has the right to assign or otherwise transfer its rights and obligations arising from its relationship with the Buyer, in whole or in part, to third parties without any additional agreement or notification of the Buyer in order to ensure the timely and complete provision of goods, works, and services offered to Consumers and Users on the Site.
2. The online store and the services provided may be temporarily partially or completely unavailable due to maintenance or other work or for any other technical reasons, with or without prior notice.
3. In relations between the User/Buyer and the Seller, the legislation of Ukraine shall apply.
4. In case of any questions or complaints from the User/Buyer, he/she should contact the Seller by telephone or other available means.
5. The parties will attempt to resolve any disputes that arise through negotiations. If agreement is not reached, the dispute will be referred for consideration in accordance with the current legislation of Ukraine.
6. If a court finds any provision of this agreement invalid, this shall not render the other provisions invalid.
7. The content of this offer, as well as the description of the Product and/or the terms of purchase and use of the Product(s), and Services, may be subject to change and/or amendment from time to time. The Seller reserves the right to make such changes without prior approval from Buyers and Users.
8. The most current rules are posted on the online store website.
9. Changes to the information provided to Buyers and users are communicated by posting relevant news in the news feed on the online store website.
